1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legal agreement between you and Plinth B.V. ("Company," "we," "us," or "our") regarding your use of the Plinth mobile application ("App" or "Service"). By accessing or using our App, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

Plinth is a mobile application that enables users to:

• Capture high-quality photographs of objects and environments using advanced camera techniques
• Utilize both manual and guided capture modes for optimal results
• Process captured images through our cloud-based 3D reconstruction service
• Generate photogrammetric 3D models and Gaussian Splat reconstructions
• Download and share processed 3D content
• Manage projects and access premium features through our credit system

3. Account Registration and Security

3.1 Account Creation

To access certain features of the App, you must create an account by providing accurate and complete information. You may register using:

• Email address and password
• Apple ID through Sign in with Apple

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credit System, Subscriptions, and Payments

4.1 Auto-Renewable Subscription Plans

Plinth offers monthly auto-renewable subscriptions in two tracks—Standard and Professional. Each plan includes a specific number of processing credits every billing cycle, where 1 credit equals 1 processed 3D model.

The current base prices (USD) for each track are:

• Standard plans: 1 credit/month – $5.00; 5 credits/month – $15.00; 10 credits/month – $25.00; 30 credits/month – $50.00.
• Professional plans: 1 credit/month – $7.50; 5 credits/month – $22.50; 10 credits/month – $37.50; 30 credits/month – $75.00.

Subscriptions renew automatically each month and are charged to your Apple ID account. You can manage or cancel your subscription at any time via your device settings. Cancellation takes effect at the end of the current billing cycle, and must occur at least 24 hours before renewal to avoid another charge. Applicable taxes and exchange rates may cause the final price in your local currency to differ from the USD base prices listed above.

4.2 Credit Top-Ups

If you need more credits mid-cycle, you can purchase a 10-credit top-up bundle for $25.00 (USD base price). Top-up credits are added to your balance immediately after the App Store confirms the transaction. They are non-refundable and do not expire while your account remains active.

4.3 One-Time Credit Purchases

In addition to subscriptions and top-ups, the App may offer limited-time or promotional one-time credit packs. The exact price and credit quantity are displayed at checkout. All prices are shown in your local currency and are determined by Apple's App Store pricing tiers.

4.4 Payment Processing

All purchases are processed through Apple's App Store using the payment method tied to your Apple ID. Apple may charge your payment method within 24 hours prior to the end of the current period for subscription renewals. Prices are subject to change, and the App will always show the most current price before you confirm a purchase. All sales are final unless required otherwise by applicable law.

4.5 Credit Usage

Credits are consumed when you submit a project for 3D reconstruction processing. Credits are non-transferable and non-refundable except as required by law. Credits granted through subscriptions renew monthly, while credits purchased via top-ups or one-time packs remain available until used.

5. Project Lifecycle & Data Retention

We manage project storage using an automated lifecycle system described in our Data Retention Policy. Key rules include:

• Free users: Maximum of 3 unpurchased projects, each kept for 14 days. Warnings arrive on Day 7 (in-app/email) and Day 12 (push).
• Active subscribers: Unpurchased projects remain available for 30 days. We send reminders on Day 23 and Day 28 so you can upgrade or buy before deletion.
• Cancelled subscriptions: All projects stay accessible for 3 months after cancellation with staged alerts at Day 75, Day 83, and Day 89. Reactivating within that window preserves everything.
• Purchased projects: Remain available indefinitely while your account is active. After 12 months of inactivity we may archive them to lower-cost storage, but they can be restored within hours on request.

These lifecycle rules operate in addition to your manual deletion controls. We use emails, push notifications, and in-app banners to keep you informed before any automated deletion occurs.

6. User Content and Data

6.1 Your Content

You retain ownership of all photographs, images, and other content you upload through the App ("User Content"). By using our Service, you grant us a limited, non-exclusive license to process your User Content for the purpose of providing 3D reconstruction services.

6.2 Content Guidelines

You agree not to upload or submit User Content that:

• Contains illegal, harmful, or offensive material
• Infringes on third-party intellectual property rights
• Contains personal information of others without consent
• Violates any applicable laws or regulations

6.3 Data Processing

Your captured images are processed on our secure cloud infrastructure. We implement appropriate technical and organizational measures to protect your data during processing and storage.

7. Intellectual Property Rights

7.1 App Ownership

The App, including its design, functionality, and underlying technology, is owned by Plinth B.V. and protected by copyright, trademark, and other intellectual property laws.

7.2 Generated 3D Models

You own the 3D models generated from your User Content. However, we retain the right to use aggregated, anonymized data for improving our services.

7.3 Restricted Use

You may not reverse engineer, decompile, or attempt to extract the source code of the App or its underlying algorithms.

7.4 License Grant

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use the App on Apple-branded devices that you own or control for your personal or internal business purposes. This license does not permit you to distribute the App or make it available over a network where it could be used by multiple devices at the same time, and it confers no ownership interest in the App or any related intellectual property.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information when you use our Service.

9. Service Availability

9.1 Service Uptime

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

9.2 Processing Times

3D reconstruction processing times may vary based on project complexity and current service load. We aim to process most projects within 24-48 hours but do not guarantee specific completion times.

10. Prohibited Uses

You agree not to use the App for:

• Any illegal or unauthorized purposes
• Circumventing security measures or accessing unauthorized areas
• Interfering with or disrupting the Service or servers
• Creating multiple accounts to abuse free trial or promotional offers
• Automated or bulk processing without prior authorization

11. Disclaimers and Limitations

11.1 Service Disclaimer

The Service is provided "as is" without warranties of any kind. We do not guarantee the accuracy, quality, or completeness of 3D reconstructions generated through our Service.

11.2 Limitation of Liability

To the maximum extent permitted by law, Plinth B.V. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless Plinth B.V. from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any reason deemed appropriate in our sole discretion.

15. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes will be subject to the exclusive jurisdiction of the courts in the Netherlands.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
